Abstract Operative and search activity is one of the problem areas in the sphere of punishment execution, as cases of committing new crimes annually are registered both by persons serving sentences in penitentiary institutions and by staff of the State Criminal Enforcement Service of Ukraine. The above points to the significant miscalculations in the organization of operational and search activities in the colonies and the shortcomings of preventive activity in the organs and institutions of execution of sentences.
The problem identified needs to be addressed, including at the scientific level. In view of this, the purpose of the article is to find out the essence of what is enshrined in Art. 104 of the Criminal Code of Ukraine the concept of “operational search activities in the colonies”, the formulation on the basis of this author’s definition of the specified concept and the derivation of its system-forming features.
The notion of “investigative activity in the colonies” proposed by the authors has not only theoretical but also practical meaning, which should be taken into account in the improvement of the legal mechanism on the issues of operative and investigative activity in the sphere of execution of sentences. The theoretical aspect is that the scientific understanding of one type of operative and search activity has been expanded, namely: operative-search activity in the colonies, and appropriate methodological measures have been created for further research in this area. The practical meaning of the formulated concept of “operative and search activity in the colonies” is that the above definition can be used in practice in the implementation of specific applied tasks of the Concept of reforming (development) of the penitentiary system of Ukraine, as well as in deciding the feasibility of functioning in the sphere of implementation the penalties of Ukraine for operational units of bodies and institutions of execution of penalties.
